everybody has there own opinions but everything people are quoting on here isnt law its legislation or acts which can only be given the force of law by consent so no consent no law u can consent by giving ur name address and d.o.b or by showing your driving liscence etc people may think its all b*llsh*t but then they vote a goverment in then moan about what they are doing to the country lol if only they knew how it worked im glad i took the time to lern and still lerning now like i said everybody allowed there opinion

So basically what you're say is a person can refuse to consent to this sort of situation by refusing to give their name, address etc., on the NIP? And then said person has the speeding offence effectively dropped - because of the lack of confession - and the charge then becomes one of 'failure to supply' which carries a higher fine potential (up to £1,000 decided by the magistrate) and double the points (6 standard as opposed to 3 for speeding) and said magistrates rarely take any kind of defence against the failure to supply charge as, simply put, the person is guilty from word one and the onus is on them to prove they aren't guilty.

That's how it works, effectively. Right or wrong - and in my mind (plus the EU I believe) it's wrong. But it happens. Question is how to avoid it, short of the obvious which is to not speed (or get caught) in the first place!

Back in Northern Ireland we use a special loophole in the law called PETROL :twisted: :twisted: :twisted: simply hang tyres over offending camera and then put in place the defence of PETROL and ignite said camera.....case dismissed :twisted: :twisted: :twisted: :shock: :crazy: :whistle: :finger: P.S this method also works for mobile speed camera vans, and hand held cameras and operaters :lol: :lol: :lol: :lol: :lol: :rambo:

failure to supply as u put it is also a legeslation there are videos on you tube of people in court turning the magistrate judge inside using these methods as a magestrate court is a place of business so only really deal in fines etc check freeman in court on you tube and then tell me that it doesnt work them boys really know what to say its funny to watch it unbelievable to start with but i thought it too till i started to look into the freeman stuff ive used it so far on a debt company chasing me for money not heard from them for 4 months

This much is true.

Being a pedantic grammar/spelling Nazi aside, I've seen a couple of the magistrate court vids (referred to in your later post) and find the whole idea intriguing, but couldn't find anything directly related to motoring offences.

I must admit though, I did greatly enjoy this one and am curious as to the eventual outcome... i.e. wether they came and bludgeoned down the guy's door and hauled him off to chokey at a later date.

Have you got a linky to anything specifically appertaining to Freeman on the Land dodging the bullet for speeding etc. ?

theres no direct links for speeding has all the freeman use the no contract rule so it never goes to court but its all the same basis really ounce you start to read and understand the system a little more yea there are occasions ive heard of when the police have tried to become heavy handed lol but its never worked as the freeman allways film whenever police are around a few names to look up are john harris (tpuc website) raymond stclair hes very clued up when it comes to dealing with the law but on there websites there are plenty of links to other websites such as beat the balliff which is very good pepipoo is a motoring website with some good info on it

Yes bazzle; I understand the principle behind refusing to contract with the court, I'm just wondering if it has specifically been used to evade penalties and sanctions for motoring offences.

I am very familiar with Pepipoo; they've been an immeasurable help over the past few years with various situations.

Things is "I've heard" doesn't really inspire confidence from where I'm sitting and having had a good look over TPUC's website, I can't find anything appertaining specifically to motoring offences.

Also, the eventual outcome of the poll tax prosecution which I posted a link to isn't anywwhere to be seen. Again, I wonder what happened? I's have thought that if it had been properly successful, it would have been all over TPUC... but it isn't. Maybe I missed it and it's right on the front page? Do post a linky if you find it.

You keep pushing the Freeman angle, but seem to be sadly unable to provide any evidence that it works.

Don't get me wrong; I like the idea of being able to ignore statutes as much as the next slightly naughty but not seriously criminal man (most of us at the last count methinks)... I'd just like to know I'm safe before I start taking the p*ss in court situations.

Of course, if you are that confident that it will apply to us bikers, why not take a trip down the A38 at a safe, but well in excess of the posted limit, speed and get flashied a few times? I'll even volunteer to come with you to document your discombobulation of the court when they summons your person to answer for the alleged offences.

Just a thought.

At the min im in the process of trying to get the father in law off a speeding fine but its been made harder by him sighning the original pcn that got posted to him ive sent 2 notices and his court case has been posponed twice his next hearing is on the 12th aug i am still waiting a reply from the second notice i sent the magistrates the method works but im still in the learning process my self and to be able to use these methods you need a good understanding of how it works 1 mistake can contract you after 6 months of hard work and letters

as for the videos you been looking for you have to look daily really because sites and videos are getting shut down daily ive seen videos one day and never found them again Raymond stclair is very clued up in the legal side of things check his site out

Which part of the A46 did the speeding offence occur, as from A1 South Bound the A46 is Dual Carriageway right up to Lincoln South turn off, therefore if you were idenitifed on that bit, you won't get a ban as limit is 70mph.

Disquals only occur when you do 30mph above speed limit.

I always ride within 10% of the speed limit. Except the A5 from Walsall to Cannock as the speed cameras are not set at 10% + 2mph, because Staffordshire Speed Camera partnership or not human.

If it goes to court, then you need a very good traffic solicitor (A few good ones in the Lace Market). And I would advise that you signup for advance training, that way, you are making it clear that you have taken heed of your actions.
Your solicitor can then state that you are an advanced rider, and despite the road conditions (assuming the road was dry and clear and visibility was good) you should get a fine and 6 points on your licence.
